أحكام الزواج

لماذا شرع الله الزواج بين الذكر والأنثى:

خلق الله تعالى الإنسانَ، وشرعَ الزَّواج بينَ الذَّكرِ والأنثى ليتحقَّقَ التَّكامل والتَّوازِنُ ويحصلَ الأُنْسُ والانسجام ويَعْمُر الكونَ، وقد جعل الله تعالى الازدواج والتَّقابل بينَ جميع المخلوقات -من أصغرها إلى أكبرها- سنَّةً كونيَّةً، وآيةً منْ آيَاتِ قدرتِهِ تعالى، قال تعالى: ﴿ وَمِن كُلِّ شَيْءٍ خَلَقْنَا زَوْجَيْنِ لَعَلَّكُمْ تَذَكَّرُونَ ﴾ [الذاريات: 49].

– فالله خلق شيء في الكون وجعل فيه تكاملا بين الذكر والأنثى أو الموجب والسالب..

حكمة مشروعية الزواج

1- بناء المجتمع:

الزَّواج هوَ السَّبيل الوحيد لإنشاء أسرة على أُسس سليمة، فالأسرة تُعدُّ اللَّبنة الرئيسة في بناء المجتمع؛ لذلك حضّ الإسلام على الزواج ورغب فيه. قال: (يا مَعْشَرَ الشَّبَابِ، من اسْتَطَاعَ مِنْكُمُ الْبَاءَةَ فَلْيَتَزَوِّجُ، فَإِنَّه أَغَضُ لِلْبَصَرِ، وأَحْصَنُ لِلْفَرْج ) (رواه البخاري).

فمن يقول: إن عدم الارتباط بالأسرة يعطي للفرد مجالًا أكبر من الحرية في الوقت والفكر؛ مما يمكنه من الابتكار والإبداع: نقول له إن عدم الارتباط بالأسرة يجعل الانسان مضطربا داخليا  غير مستقر نفسيا عاجزا وغير قادرٍ على الابتكار والابداع.

2- تحصين المجتمع:

 يحققُ الزَّواج العفاف والاستقرار للمسلم والبعد عن الحرام، قال تعالى: ﴿ وَمِنْ ءَايَاتِهِ أَنْ خَلَقَ لَكُم مِّنْ أَنفُسِكُمْ أَزْوَاجًا لِتَسْكُنُوا إِلَيْهَا وَجَعَلَ بَيْنَكُم مَّوَدَّةً وَرَحْمَةً … ) [الروم: 21].

 فعندما يعف الإنسانُ نفسه ويصونَها عن الحرامِ فإنه يحصَّنَها من الأمراض المعدية، ومنعها من الانسياق لفعل الجرائم، وبهذا يتحقق حفظ المجتمع وحمايته.

ومن جانب آخر فالزَّواج يحمي المجتمع منَ التَّفَكُكِ’ فبالزواج يقوى النسب ا والروابط بينَ الأُسرِ ، فيكون التَّقاربُ والتَّعارفُ، قالَ اللهُ تعالى: ( وَهُوَ الَّذِي خَلَقَ مِنَ الْمَاءِ بَشَرًا فَجَعَلَهُ نَسَبًا وَصِهْرَا وَكَانَ رَبُّكَ قَدِيرًا ) (الفرقان: 54).

3- النَّسل:

قَالَ صلى الله عليه وسلم: « تَزَوَّجُوا الْوَدُودَ الْوَلُودَ فَإِنِّي مُكَاثِرُ بِكُمُ الْأُمَمَ» (رواه النِّسائي).

فالذُرِّيَّةُ غايةٌ مقصودةٌ في الشَّريعة الإسلامية، والزَّواجُ هوَ الطَّرِيقُ الصَّحيحُ لتحقيق هـذه الغاية وبها تستقر الحياة، قال تعالى: ( يَا أيُّهَا النَّاسُ اتَّقُوا رَبَّكُمُ الَّذِي خَلَقَكُم مِّن نَّفْسٍ وَاحِدَةٍ وَخَلَقَ مِنْهَا زَوْجَهَا وَبَثَّ مِنْهُمَا رِجَالًا كَثِيرًا وَنِسَاءً وَاتَّقُوا اللَّهَ الَّذِي تَسَاءَلُونَ بِهِ وَالْأَرْحَامَ إِنَّ اللَّهَ كَانَ عَلَيْكُمْ رَقِيبًا ﴾ [النساء: 1].

ومن يدَّعي أن من مظاهرِ التَّحضُّرِ تحديدُ النَّسلِ وعدم الإكثارِ مِنَ الأَولادِ:

نقول له إن التحضر الحقيقي هو يكون بإتباع سنة النبي عليه السلام وهديه في تكاثر النسل وتظهر أهمية النسل وقت الكوارث الطبيعية والحروب.

3- بلوغ السموّ الإنساني:

الزواج مفعول يهذب النَّفْسِ البشرية، فالإنسانُ – رجلًا كانَ أوِ امرأةً- بمجرد شروعه في تكوين أسرة، تتغير مفاهيمه، وتتبدل اهتماماته، فقد أصبحَ كلٌّ مِنَ الطَّرفِينِ مسؤولًا عنْ حفظِ عِرْضِ الآخر، وأصبحتِ الشَّهواتُ منظمةً، وبدأ شعورُ الأبوة والأمومة ينمو ويتواجد، وبمجرَّدِ الإنجاب: تبدأ التّضحياتُ بتربية الأبناء والقيام بحقوقِ الأسرة، وبهذا يكونُ الزَّوجُ والزَّوجةُ قد انتقلا من حياة المراهقة إلى حياة المسؤولية المتبادلة، وهذا هو السمو الإنساني بأعلى معانيه.

فالزواج له دور كبير في وعي التفكير ونضجه عندَ كلا الزوجين, فبعد الزواج يتحمل كلاهما مسؤوليات لم يقوما بها من قبل وتنضج رؤيتهما على مستقبل ينظران إليه بنظرة واعية وتفكير ناضج.

 – والسبب في تغير نظرة المتزوج للحياة بعد زواجه لأن نظرة المتزوج مبنية على حملانهما المسؤولية تجاه أسرتهما, أما غير المتزوج فنظرته قاصرة على نفسه وشهواته.

أسس اختيار الزوج والزوجة

1- الدين وحسن الخلق:

التزام المرأة بدينها هو مقصد، وغاية يبحثُ الخاطب عنها في مخطوبته؛ ذلك لأن المتمسكة بدينها  هي الَّتي تُعينُ زوجها على طاعة الله تعالى، وتساعده في الابتعاد عن المحرَّماتِ، وتقفُ معه في تكوين أسرة مؤمنة صالحة، قال: « تُنْكَحُ الْمَرْأةُ لِأرْبَع: لِمَالِهَا، وَلحَسَبِهَا ، وَلِجَمَالِهَا، وَلِدِينِهَا، فَاظْفَرْ بذَاتِ الدين تربت يداك)

وهذا المقصد كما يُطْلَبُ في المرأةِ فهوَ يُطلبُ فِي الرَّجلِ، قَالَ صلى الله عليه وسلم:

(إِذَا خَطَبَ إِلَيْكُمْ مَنْ تَرْضَوْنَ دِينَهُ وَخُلُقَهُ فَزَوِّجُوهُ، إِلَّا تَفْعَلُوا تَكُنْ فِتْنَةٌ فِي الْأَرْضِ، وَفَسَادٌ عَرِيضٌ)

2- التَّكَافؤ بينَ الزوجينِ:

 قالَ صلى الله عليه وسلم: « تَخَيَّرُوا لِنُطْفَكُمْ، وَانْكِحُوا الْأَكْفاءَ، وَأَنْكِحُوا إِلَيْهِمْ» ابْنُ مَاجَهْ

ويقصد هو إيجاد عوامل مشتركة بينهما، كالتقارب في العلم والسِّنِّ، وذلك لأَنَّهُ يَزِيدُ مِنْ إمكانية الانسجامِ والتآلف بينهما، وأدعى إلى استمراريَّةِ التَّعايش والمحافظة على الأسرة.

– فإنَّ تقديم ذوي المناصب والمكانة العالية في الزواج على أصحابِ الدِّينِ والخُلُقِ الحسنِ، يؤدي إلى  الطلاق وسوء العشرة بين الزوجين وذلك نتيجة لغياب الدين والتقوى والتكافؤ ين الزوجين.

شروط عقد الزواج

يُشْتَرَطُ لصحَّةِ عقدِ الزَّواجِ عدَّةُ شروط لا يصح النكاح إلا بها:

أولا: التراضي:

رضا كلُّ منَ الزوجين بالآخرِ شرط لا بد من تحققه، فالغاية منَ الزَّواج لا تتحقَّقُ إِذا أُرْغِمَ أحدُ الطَّرفين على العيش مع شخص يكرهُهُ؛ إذْ لن يتمكَّنَ منَ القيام بحقوقِ الزَّوجيّةِ كما ينبغي؛ لذلك اشترط الإسلامُ قبولَ الرَّجلِ بالمرأة وقبول المرأة بالرجل عند عقد النكاح قال صلى الله عليه وسلم: « لا تُنكَحُ الأيم (وهي من سبق لها الزواج) حَتَّى تُسْتَأْمَرَ) (أي توافق صراحة)، وَلَا تُنْكَحُ الْبِكْرُ حَتَّى تُسْتَأْذَنَ أي حتّى تعطي إشارة بالموافقة، لأنها تستحيي، قالوا يا رسول اللهِ، وَكَيْفَ إِذْنُهَا؟ قَالَ: أَنْ تَسْكُتَ» (البخاري).

ولكن ظهرت بعض العادات والتقاليد في بعض البلدانِ تقضي بأحقَّيَّةِ ابنِ العمّ في الزواج، وإن كانت المخطوبة غير راضية، فهذا مخالف للتشريع الإسلامي، والنبي عليه السلام اشترط رضى المخطوبة ليكون العقد صحيح.

من شروط عقد الزواج:

ثانيا: الولي

الشرط الثاني من شروط صحة العقد في النكاح هو وجود ولي المرأة ورضاه، ويُقصد بالولي في النكاح: «من يلي أمر المرأة، وهو المسلمُ العاقل البالغ العدلُ الذكرُ الرّشيدُ – وهو الأب، فإذا لم يوجد لأي سبب فالجد ثم الأخ ثم العم، وهكذا»، والأصل في اشتراط الولي قول النبي صلى الله عليه وسلم: ( أيما امرأة نُكِحَتْ بغير إذن وليها فنكاحها باطل، فنكاحها باطل، فنكاحها باطل» (رواه أحمد). قال تعالى: “وَأَنكِحُوا الْأَيامَى مِنكُمْ ” [النور: 32]. فالخطاب في الآية الكريمة للأولياء. وقال: “لا نكاح إلا بولي” (رواه أحمد).

مخاطر تزويج المرأة نفسها دون ولي

يؤدي ذلك إلى كثير من المفاسد:

1- منها خداع الزوجة.

2-سهولة أكل حقوقها.

3-انتشار المفاسد في المجتمع بسبب تزويج البنات أنفسهن ممن تُعجبن به ثم اكتشاف أنه وقعت ضحية لعصابة للاستغلال أو زواج المتعة.

ثالثا: الشاهدان:

قال صلى الله عليه وسلم: (لا نكاح إلا بولي وشاهدين» (الطبراني، لا يصح العقد بلا شهود إثباتًا للزواج، وحفظاً للحقوق، وخصوصًا في حال المنازعات، وانعدام الشُّهود على عقد الزواج فيه مدعاة للتلاعب بالعقود أو النسيان وضياع الحقوق.

 الآثار المترتبة على عدم وجود شاهدين في عقد الزواج

1- ضياع حق الزوجة حال المنازعات إذ لا يوجد من يشهد على حقوقها.

 2 – سهولة تزوير العقود أو إنكارها من أجل تحقيق مصالح شخصية.

من شروط عقد الزواج

رابعًا: الكفاءة في الدين

يُقصد بالكفاءة في الدين مساواةُ الزَّوْجِينِ في الدِّينِ، فلا يجوز أن ينكح المسلمة غير المسلم، وكذلك لا يجوز للمسلم أن ينكح مشركةً لا تؤمنُ بدين سماوي، قال تعالى: ﴿ وَالْمُؤْمِنُونَ وَالْمُؤْمِنَاتُ بَعْضُهُمْ أَوْلِيَاءُ بَعض } (التوبة 71)، وقال تعالى: ( وَلَا تَنكِحُوا الْمُشْرِكَاتِ حَتَّى يُؤْمِنَّ وَلَأَمَةٌ مُؤْمِنَةٌ خَيْرٌ مِّن مُّشْرِكَةٍ وَلَوْ أَعْجَبَتْكُمْ وَلَا تُنكِحُوا الْمُشْرِكِينَ حَتَّى يُؤْمِنُوا وَلَعَبْدٌ مُّؤْمِنُ خَيْرٌ مِّن مُّشْرِك وَلَوْ أَعْجَبَكُمْ ) (البقرة: 221).

واستثنى الله عز وجل للمسلم جواز الزواج من الكتابية قال تعالى: “الْيَوْمَ أُحِلَّ لَكُمُ الطَّيِّبَاتُ وَطَعَامُ الَّذِينَ أُوتُوا الْكِتَبَ حِلٌّ لَكُمْ وَطَعَامُكُمْ حِلٌّ لَّهُمْ وَالمُحْصَنَاتُ مِنَ الْمؤمنات وَالمُحْصَنَاتُ من الَّذِينَ أُوتُوا الْكِتَبَ مِن قَبْلِكُمْ ” (المائدة: 5).

نتائج زواج المسلمة من غير المسلم

1- على الأبناء: فالأبناء يتأثرون بتربية والدهم الدينية لهم,  فلو كان الزوج غير مسلم أدى ذلك لبعد الأبناء عن الإسلام.

2-على الزوجة: والمسلمة إذا تزوجت بغير مسلم ستتأثر فطبيعة حياته وعاداته ومعتقداته مختلفة عنها.

3- على المجتمع: سيكون الأبناء بعيدين عن القيم والعادات ومنسلخين من المجتمع بل ويتأثرون بقيم وعادات آبائهم.

الأنكحة المعاصرة (المستحدثة)

 انتشر في السنوات الأخيرة أنواع جديدة ومستحدثة للنكاح، ذكرها العلماء، ووضحوا أحكامها من حيثُ الصحة والبطلان، ومنها على سبيل المثال:

(الزَّواج العرفي – الزَّواجُ الصّوري – زواج المسيار – الزواج بنيَّةِ الطَّلاقِ الزَّواج عبر الإنترنت (مواقعُ الزَّواج) – زواج فرند….) وغيرها.

فهذه الأنواع لها أحكامها الخاصة بها، لأنّ كلّ واحدٍ منها له تفاصيله المختلفة، ولكنَّ الأساس الذي يجمعُ كُلَّ تلك العقودِ هُوَ أَنَّ عقدَ الزَّواج لا بد فيه من عقد صحيح، على نية التأبيد، بمهر مقدرٍ، وشاهدَيْنِ، وولي للمرأةِ، وإشهارِ الزَّواج بينَ النَّاسِ بدعوة أو وليمة والإحصانِ بألا ينكح إلا عفيفةً، ولا تَقبل المرأةُ إِلَّا مَنِ اشتهر بالعفّةِ، فما وافق ذلك فهو جائز، أما ما لم يوافق ذلك فهو مخالف للشَّرع ويُعتبرُ عقدًا باطلًا.

ولعل سبب انتشارِ عُقودِ الزَّواج المعاصرةِ بينَ الشَّبابِ في بعض البلدان:

هو غياب الوعي الديني والمعرفة بمخاطر مثل هذه الأنواع من الأنكحة.

مقترحات لتحذير الشباب من الأنكحة المعاصرة

1- توعية الشَّباب بمخاطرِ عقود الزواج المعاصرة التي لا توافقُ الشَّرْعَ.

2- فلابد من متابعة الأبناء بصفة مستمرة وتوعيتهم حتى لا يقعوا في هذا الخطر.

 حقوق وواجبات كلاً من الزوجين

بمجرد إتمام عقدِ الزَّواج تترتب الحقوق والواجبات لكلِّ منَ الزوج والزوجة تجاه بعضهما البعض، وهي على ثلاثة أقسام:

أَوَّلًا: حقوق الزوج:

1- الطَّاعةُ في غير معصية الله تعالى.

2- المكوث والجلوس في البيت قال تعالى: ” وَقَرْنَ فِي بُيُوتِكُنَّ وَلَا تبرجن تبرج الْجَاهِلِيَّةِ الْأُولَى” ( الأحزاب: 33).

3- ألا تُدْخِلَ بيتَهُ مَنْ يكره.

4- حِفْظُ عرضه وماله وولده وبيته، قال صلى الله عليه وسلم: «والمرأة في بيت زوجها راعية وهي مسؤولة عن رعيتها » (البخاري).

ثانيا: حقوق الزوجة:

1- وجوب الإنفاق عليها، ويشمل: المأكل والملبس والمسكن.

2- حُسْنُ المعاشرة، ويشمل: حفظ أسرارها، وتجنيبها الحَرَجَ وعدم الحطَّ من كرامتها.

3- صيانة عرضها، وحفظ مكانتها وقدرها، وحمايتها.

ثالثًا: الحقوق المشتركة:

1- حسنُ العِشرة بينهما بالمعروف، والتسامح والاحترام المتبادل، والتَّعاونِ، وإِسعادِ كلَّ منهما الآخر.

2- حِلُّ استمتاع كلٍّ منَ الزَّوجين بالآخرِ على الوجهِ الَّذِي حَدَّدَهُ الشَّرِعُ.

3- حرمة المصاهرة، فتحرمُ الزَّوجةُ على أصولِ الزَّوج وفروعه، وكذلك الزوج

بمجرد العقدِ عليها، ويَحْرُمُ على فروعها بعد الدخول بها.

4- ثبوت نسب الأولاد لكلا الزوجين.

5- ثبوتُ حقَّ التَّوارِثِ بينهما.

والسبب في إرساء النَّبي مبدأ احترام الزوجة وتقدير رأيها، رغمَ أنَّ كثيرًا مِنَ النِّساءِ غير متعلمات:

لأن هذه الحقوق ليس لها علاقة بالتعليم بل إنها تكتسب من منطلق أنها زوجه سواء كانت متعلمة أو غير متعلمة لمجرد أنها مسلمة )

 والعلاقة بين الخلافات التي تكونُ بين الأزواج في المحاكم الشَّرعيّة، وبين معرفة الحقوقِ الشَّرعيَّةِ لكلا الزوجينِ:

أن معرفة الحقوق الشَّرعيّة لكلٍّ من الزوجين يؤدّي إلى الوفاء بها، بينما الجهل بحقوق الزوج الآخر يؤدّي إلى سوء الفهم واعتبار كل طرف أنَّ الطرف الآخر مُقَصِّر في حقه.
